Charity Terms and Conditions

CHARITY TERMS & CONDITIONS Version: March 10, 2025 GiveWise Foundation Canada ("GWFC" or "GiveWise")


1. About These Terms

These Charity Terms & Conditions ("Terms") constitute a binding agreement between you ("Charity," "you") and GiveWise Foundation Canada (GiveWise, "we," "our," or "us") regarding the use of GiveWise’s services, including the GiveGenius Give Button and other gift processing tools. By registering with GiveWise, you agree to abide by these Terms.

2. Charity Eligibility

To use GiveWise services, including the GiveGenius Give Button, you must:

  • Be a registered Canadian charity in good standing with the Canada Revenue Agency (CRA).

  • Use funds in accordance with the donor’s designated purpose when specified.

  • Comply with Canadian privacy laws in handling donor data.

GiveWise reserves the right to approve or reject any charity access if a charity fails to comply with these Terms.

3. Data Handling & Privacy

  • The following donor details are shared with the charity: donor name, donor email , Giving Fund Name, gift value, and gift designation.

    • If the donor opts to remain anonymous, no personal details will be shared.

  • Donor data must be used only in compliance with Canadian privacy laws and cannot be sold or misused.

  • GiveWise does not endorse or verify the charities listed on our platform but only facilitates donations.

4. Fees & Disbursements

  • GiveWise does not withhold any fees from Gift Disbursements sent to charities.

  • There are some fees applied to contributions from donor but this does not apply to the charities disbursement. Some fees include (credit card processing, securities transaction fees).

  • Gifts are disbursed to charities weekly. GiveWise sends all funds to charities electronically. Therefore, if a charity has set up their direct deposit, funds should be received by the charity within 9 business days of gift approval.

  • If a charity cannot be reached or direct deposit is not set up, GiveWise reserves the right to cancel gifts, at which point the funds will be returned to the donor’s Giving Wallet balance for distribution elsewhere.

  • There is no minimum disbursement threshold applied.

  • GiveWise reserves the right to take up to 30 days for money movements of over $100,000.

  • If a gift payment fails and are returned to GiveWise, we will make every effort to contact the charity to correct the banking information. Gift disbursements will be reissued but a $40 Administration Recovery Fee will be withheld from the proceeds.

5. Compliance & Charity Responsibilities

  • Fund Usage: Charities must use all donated funds for the specific purpose stated by the donor.

  • Misuse of Funds: If a charity misrepresents the use of funds or violates these Terms, GiveWise may immediately terminate access to the platform.Comment

  • Gift Acceptance Policy (GAP): All charities must comply with GiveWise’s Gift Acceptance Policy (GAP).Comment

  • Restricted & Complex Assets: Certain donations (e.g., restricted funds, complex assets) may require GiveWise review before acceptance, as outlined in the GAP.Comment

6. Marketing & Co-Branding Restrictions

  • No Endorsement: The use of GiveWise’s services does not imply an endorsement of any charity by GiveWise.

  • Co-Branding: Charities cannot present GiveWise as a sponsor or partner unless explicitly agreed.

  • Facilitation Only: GiveWise is a facilitator of gift processing and not responsible for marketing or fundraising outcomes.

7. Refund & Reallocation Policy

  • All donations are final and cannot be refunded to the donor.

  • If a project or cause fails, and the charity cannot accept the funds, GiveWise may reallocate the funds to the donor’s Giving Fund at its discretion.

8. Termination & Updates

  • GiveWise reserves the right to terminate access to any charity that fails to comply with these Terms.

  • These Terms may be updated periodically, and continued use of GiveWise services constitutes acceptance of any revised Terms.

9. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein. Any disputes shall be resolved in the Supreme Court of British Columbia.


By registering with GiveWise, you confirm that you have read, understood, and agreed to these Terms & Conditions.
